1. COMPANY
-
DTMK Limited is registered in England and Wales and trades under two names:
-
DTMK Training Services – delivering regulated qualifications and community training
-
DTMK Driving School – delivering learner driver tuition, advanced driver training, and related services
-
These Terms and Conditions apply to all services provided by DTMK Limited. Where provisions differ, the relevant rules for Training Services or Driving School are set out separately.

2. DEFINITIONS
-
Customer: An individual, company, organisation, school, nursery, youth group, or other entity booking training or lessons with DTMK Limited
-
Delegate: An individual attending a training course provided by DTMK Limited
-
Learner Driver: An individual receiving driving tuition from DTMK Driving School
-
Regulated Course: Qualifications regulated by Ofqual and awarded through recognised awarding organisations
-
Community Course: Non-regulated training sessions certificated by DTMK Limited
-
3. BOOKING AND CONFIRMATION
-
Training Services
-
Bookings are not confirmed until written confirmation has been issued by DTMK Limited
-
Submission of a booking form confirms agreement with these Terms and Conditions
-
Delegate transfers may be permitted at DTMK’s discretion prior to the start of the course
-
Where the Customer provides the venue, they must supply an accessibility statement and relevant risk assessments in advance
-
Driving School
-
Learner Drivers must hold a valid UK category B provisional or full driving licence
-
Learners must inform instructors of any medical or legal issues affecting entitlement or ability to drive
-
Lessons booked via the Total Drive app or directly with the instructor
-
Additional passengers are not normally permitted
-
Alternative pick-up or drop-off points must be requested when booking; delays or cancellations caused are not the responsibility of DTMK
-
If a learner is not present within 10 minutes of arrival, the lesson will be cancelled and the fee lost

4. PAYMENT
-
Training Services
-
Community Courses: payment in full at booking
-
Commercial/Corporate: invoiced with 30-day terms unless agreed otherwise
-
Overdue invoices may incur interest at 8% above the Bank of England base rate under the Late Payment of Commercial Debts (Interest) Act 1998
-
Driving School
-
Lesson payments due by the evening before the lesson
-
Block bookings must be used within 6 months unless agreed otherwise
-
Credits in Total Drive: 1 credit = 1 hour
-
Lessons are normally 2 hours; one session weekly is ideal, or two hours fortnightly
-
Prepaid lessons are non-transferable
-
Payment methods: bank transfer (preferred), or card via Total Drive (admin fee applies). Cash not accepted
-
Receipts automatically emailed via Total Drive

5. CANCELLATIONS AND REFUNDS
-
Training Services
-
Cancellations must be in writing
-
Community Courses: 7+ days’ notice = full refund; under 7 days = non-refundable
-
Corporate bookings: 14+ days’ notice = full refund; under 14 days = up to 100% charge
-
DTMK may cancel/reschedule courses; customers offered alternative or full refund. No liability for travel, accommodation, or other costs
-
If venues fail to provide accessibility or risk assessments, DTMK may cancel or postpone
-
Driving School
-
48 hours’ notice required to cancel/amend lessons; less notice = full charge
-
If DTMK cancels due to instructor illness or vehicle fault, lesson will be rescheduled or refunded
-
DTMK not liable for other costs
-
6. TRAINING, LESSONS, AND ATTENDANCE
-
Training Services
-
Delegates must attend all sessions in full; late arrivals/absences may lead to exclusion without refund
-
Practical activities require suitable clothing (kneeling/lying on floor)
-
Delegates on regulated qualifications must meet age and competency requirements
-
Reasonable adjustment requests must be made at least 48 hours before the course
-
Driving School
-
Learners must not attend under the influence of drugs or alcohol; suspected intoxication = cancellation without refund
-
Learners must follow instructions; refusal or unsafe behaviour = termination without refund
-
Delays caused by traffic communicated via Total Drive; lessons may be extended or shortened by agreement
-
Instructors not liable for personal belongings left in vehicles
-
Learners must provide licence check codes when requested and bring their licence to every lesson
-
Appropriate clothing and footwear required; unsafe dress = cancellation without refund
-
During times of community infection (e.g. COVID-19), face coverings may be required. Vehicles will be ventilated and cleaned
-
7. VEHICLES AND EQUIPMENT

Training Services
-
Venues must be private, safe, and compliant with awarding body and H&S standards
-
All mains-powered equipment PAT tested
-
Venues must provide parking and safe unloading
-
Driving School
-
Vehicles provided are clean, roadworthy, and dual-controlled
-
Replacement vehicles may be used if necessary
-
Lessons in learners’ own vehicles allowed at instructor’s discretion with insurance and safety checks
-
Mechanical faults = unused lesson time credited
-
Faults caused by driver error = lesson lost but no repair charge
-
Learners responsible for fines or offences committed during lessons
-
8. PRACTICAL DRIVING TEST ARRANGEMENTS
-
DVSA does not provide cars for tests
-
Use of DTMK vehicles requires syllabus completion to test standard and passing of two mocks three weeks before the test
-
DTMK may withdraw vehicles for safety reasons; instructor’s decision is final
-
If DTMK cancels within 14 days due to illness or breakdown, DVSA fee reimbursed
-
Instructor’s test day fee charged at normal lesson rate
-
Instructor accompaniment on tests is optional
-
DVSA test requirements available at gov.uk

9. CERTIFICATION
-
Training Services
-
Certificates issued only when courses/assessments are successfully completed
-
Community course certificates issued to all attendees
-
Replacement certificates may incur an admin fee
-
Driving School
-
Theory resources may be provided if the learner maintains at least one 2-hour lesson monthly
-
10. HEALTH, SAFETY AND EQUALITY
-
Learners/delegates must declare relevant health conditions
-
Emergency medication must be brought to sessions
-
Learners must meet eyesight standards and wear corrective lenses where required. Instructors may re-check vision
-

11. COMPLAINTS AND APPEALS
-
Training Services
-
Complaints, appeals, and malpractice handled under DTMK formal policies (available on request)
-
Driving School
-
Complaints addressed to Christopher Cook, Managing Director (christopher@dtmk.co.uk)
-
If unresolved, complaints may be escalated to the DVSA Registrar of ADIs (gov.uk)
-
12. LIABILITY
-
No liability for lost or damaged personal belongings
-
Liability limited to the amount paid for the booking
-
Nothing excludes liability for death or personal injury due to negligence
-
Learner Drivers responsible for driving offences, fines, and penalty points during lessons
-
13. DATA PROTECTION AND PRIVACY
-
DTMK is ICO registered
-
Personal data processed in accordance with UK law and retained for at least three years
-

14. TRAINERS AND INSTRUCTORS
-
All trainers hold relevant qualifications
-
Trainers for regulated qualifications hold subject-specific qualifications or are registered healthcare professionals
-
Instructors are ADI-qualified or in supervised PDI training
-
All staff are DBS-checked and safeguarding trained
-
15. GOVERNING LAW
-
These Terms and Conditions are governed by the laws of England and Wales. Both parties agree to the exclusive jurisdiction of the courts of England and Wales.
